Terms of service
1. Scope
These General Terms and Conditions apply to all orders placed by consumers through the online shop of
LEV MÉS
Owner: Dr. rer. nat. Ebru Doğanay
Siemensstr. 31
73733 Esslingen am Neckar
Germany
(hereinafter “LEV MÉS”, “we” or “us”).
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
2. Offer and conclusion of contract
The presentation of our products in the online shop does not constitute a legally binding offer. It is an invitation to the customer to submit a binding offer to purchase.
By submitting an order through our online shop, the customer makes a binding offer to purchase the selected goods.
Receipt of the order is confirmed automatically by email. This automatic acknowledgement does not yet constitute acceptance of the offer.
The contract is concluded when we accept the order by sending an express order confirmation by email or by dispatching the goods.
If an item is no longer available due to a technical error despite being shown as available in the online shop, we reserve the right not to accept the offer. Any payments already made will be refunded in full.
3. Characteristics of natural stone jewellery
Some of our jewellery is made from natural gemstones, natural stones and other natural materials.
Natural stones are unique materials. Differences in colour, structure, pattern, transparency, inclusions and surface are natural characteristics of these materials and make each piece individual.
Colour and shape may vary slightly.
Product images are created with care. Minor differences between the online presentation and the actual product may arise due to screen settings, lighting conditions and photographic presentation.
Variations in shape, surface or finish resulting from handcrafting do not constitute a defect, provided they do not impair the customary quality or usability of the jewellery.
4. Custom-made items and special requests
Our regular range consists of finished pieces of jewellery.
Where custom-made items or special requests are agreed in an individual case, specific arrangements may be made regarding design, material selection, size or finish.
Before production begins, the customer will be informed of the material characteristics and of any differing delivery times.
The statutory right of withdrawal may be excluded for custom-made jewellery where the legal requirements for the exclusion are met.
5. Prices and payment terms
All prices shown in the online shop are total prices.
VAT is not shown because the small business exemption under Section 19 of the German VAT Act applies.
Any additional shipping costs are shown separately in the relevant offer and during checkout.
The available payment methods are shown to the customer during checkout.
Unless otherwise specified for the selected payment method, the purchase price is due immediately upon conclusion of the contract.
6. Delivery and shipping
Delivery is made to the delivery address provided by the customer.
The applicable delivery times are stated in the product offer and during checkout.
Jewellery items are dispatched after the order and availability have been successfully checked.
Different delivery times may apply to custom-made items or special commissions. The customer will be informed of these before the contract is concluded.
If a delivery delay occurs, we will inform the customer as soon as possible.
7. Retention of title
The delivered goods remain the property of LEV MÉS until payment has been made in full.
8. Care and handling of jewellery
Jewellery should be handled with care and maintained in accordance with the characteristics of the respective materials.
Contact with water, perfume, cosmetics, cleaning agents or other chemical substances may affect certain materials.
Natural changes to materials resulting from normal use or improper care do not constitute a defect.
We recommend protecting jewellery from excessive mechanical stress.
9. Statutory warranty
Statutory warranty rights apply.
In the event of defects, the customer is entitled to the statutory remedies, including subsequent performance, withdrawal from the contract or a reduction in price.
These General Terms and Conditions do not restrict the customer’s statutory rights.
10. Right of withdrawal
Consumers generally have a statutory right of withdrawal.
Further details are set out in the separate Right of Withdrawal policy.
11. Liability
We have unlimited liability for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence.
In the event of a slightly negligent breach of duty, we are liable only for the breach of material contractual obligations and only for the foreseeable loss typically arising.
Liability under mandatory statutory provisions, in particular the German Product Liability Act, remains unaffected.
12. Privacy
Information about the processing of personal data is provided in our Privacy Policy.
13. Final provisions
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory statutory protections under the law of the country in which they have their habitual residence.
